These Terms of Service govern the use of the website, services, programmes,
transport services, online learning, and other activities provided by
BRIGHTSTONE ACADEMY LTD ('Brightstone', 'we', 'our', 'us').
By accessing our website or using our services, you agree to comply with
these Terms of Service.
Definitions
'Student' means any child or person receiving services
from Brightstone.
'Parent' means the parent, guardian, or authorised person
responsible for the student.
'Services' means tutoring, coaching, holiday programmes,
transport, online classes, workshops, mentoring, and any other services
provided by Brightstone.
Eligibility
Parents must be at least 18 years old to make bookings and enter agreements
with Brightstone.
Bookings and Enrolment
- All bookings are subject to availability.

Brightstone reserves the right to accept, decline, suspend, or cancel
enrolments at its discretion.

Parents must provide accurate, current, and complete information when
booking services.
Fees and Payment
- All fees are listed in New Zealand Dollars (NZD).
- Payment must be made by the due date stated on the invoice.

Late payments may result in:
- Suspension of lessons
- Refusal of future bookings
- Additional administration fees
- Debt collection action where necessary
Cancellation and Refund Policy

Parents must provide at least 24 hours notice for cancellations or
rescheduling.

Lessons cancelled with less than 24 hours notice may be charged in full.

Refunds are not guaranteed and will be considered on a case-by-case
basis.

Holiday programmes, group bookings, and special events may have separate
cancellation terms.
Student Conduct
Brightstone is committed to providing a safe, respectful, and positive
environment.
Students must:
- Treat staff and other students respectfully
- Follow instructions from tutors, coaches, and drivers

Refrain from bullying, harassment, discrimination, intimidation, or
physical aggression
- Use respectful language
- Respect property, equipment, and vehicles
- Behave safely during transport and activities
Brightstone reserves the right to remove or suspend any student whose
behaviour places others at risk or disrupts the learning environment.
Parent Responsibilities
Parents are responsible for:
- Providing accurate emergency contact details

Informing Brightstone of allergies, health conditions, disabilities, or
behavioural concerns
- Ensuring the student is collected on time where required
- Ensuring fees are paid
- Informing Brightstone of any relevant changes
Transport Services
Where transport services are provided, parents must ensure:
- Pick-up and drop-off details are accurate
- Students are ready on time
- Students wear seatbelts and behave safely
Brightstone may suspend transport services for unsafe behaviour.
Online Services
Parents are responsible for ensuring students have access to:
- A suitable device
- Reliable internet connection
- A quiet learning environment
Brightstone is not responsible for disruptions caused by internet outages,
software issues, or device failures.
Website Use
Users must not:
- Misuse the website
- Upload harmful software
- Submit false information
- Attempt unauthorised access to the website
All website content, logos, branding, lesson materials, and educational
resources remain the property of Brightstone unless otherwise stated.
Limitation of Liability
To the maximum extent permitted by New Zealand law, Brightstone is not
liable for:
- Indirect or consequential losses
- Loss of profits or opportunities
- Damage to personal property

Delays caused by weather, illness, traffic, or events outside our control
- Technology failures during online lessons
Nothing in these Terms excludes rights that cannot be excluded under the
Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
Privacy
Brightstone handles personal information in accordance with the Privacy Act
2020.
Health and Safety
Brightstone is committed to maintaining a safe environment in accordance
with the Health and Safety at Work Act 2015.
Governing Law
These Terms are governed by the laws of New Zealand.
